ANC concerned over ruling ordering Zuma to explain cabinet reshuffle

Jonas was also fired by Zuma.

Judge Vally disagreed and instead ordered Zuma to furnish the court with all records stating the reasons for his actions.

The ruling made on Thursday by Judge Bashir Vally follows an application by the opposition Democratic Alliance (DA) on April 24 asking the court to force President Zuma to disclose his reasons for the Cabinet reshuffle.

The ANC said in a statement that the appointment of ministers and deputies, as well as reshuffling of the cabinet, was "a discretionary and political decision of the president". "The timing of the announcement of the reshuffle, in the middle of the night, also serves to highlight the real motives and intent by the President Zuma".

"We expect that document to be part of the record", said Selfe, referring to the intelligence report.

Zuma, who came to power in 2009, has been accused of corruption but survived several no-confidence votes in parliament thanks to his African National Congress (ANC) majority in the National Assembly.

The victim has been identified as Ghulam Mohammad, a resident of Sohi village under the Pahasu Police Station. Those arrested are Hunny Raghav, Pulkit and Lalit but the main accused, Gavender, is still at large.

Zuma argued he was exercising his powers in terms of section 91 (2) of the Constitution of the Republic of South Africa.

On Friday, Kodwa said that reading into the Constitution that the President must explain his Cabinet decisions was "to use the judiciary to police political decisions and sets a very worrisome precedent".

"There is a another ratings agency that is going to make an announcement about whether to downgrade South Africa, and we are hoping that the court can play with us in reviewing the rationality as soon as possible", the party's James Selfe said outside the court.

Mr Zuma has not mentioned the report publicly, but rather said his reshuffle was about promoting a younger generation of leaders.

It was not immediately clear if Zuma would appeal Thursday's ruling.

He has so far not given any specific reasons for removing Gordhan and replacing him with new Finance Minister Malusi Gigaba. "We can not allow Zuma to further abuse taxpayers' money", Bloem said.
