Illinois, other states settle with Johnson & Johnson for $33 million

Johnson & Johnson's McNeil Consumer Healthcare Division did not admit to violating any state law or regulation, or admit to any wrongdoing.

"Hundreds of millions" pf packages of popular brands like Tylenol, Benadryl, Pepcid, and Rolaids produced at McNeil's Fort Washington, PA from 2009 to 2011 were recalled in response to reports of "product oddities" like strange odors and particles in some of the products, the Pennsylvania Office of the Attorney General said in a press release heralding the settlement. Class I recalls involve situations in which there is a reasonable probability that the use of or exposure to a violative product will cause serious adverse health consequences or death.

The recalls followed reports that the medicines had a unusual odor and that particles had been found in liquid medicines. OR accused J&J of failing to publicly announce a recall of tainted Motrin in 2009 and instead sending private contractors into stores in the state to retrieve the defective products without the public knowing. The states' settlement resolves claims that McNeil unlawfully promoted its over-the-counter drugs as compliant with federal good manufacturing practices, a system that ensures products are consistently produced and meet quality standards.

Other attorneys general issued similar statements about their tolerance for marketing metal-laden or musty meds to the people of their states and districts.
